These Terms & Conditions ("Terms") govern your access to and use of the Oblicuo website, applications, and services (together, the "Service") provided by Oblicuo ("Oblicuo", "we", "us", or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms.
1. Who you are contracting with
You are entering into these Terms with Oblicuo. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization. If you are using the Service as an individual, you represent that you are of legal age to form a binding contract.
2. The Service
Oblicuo provides an AI-assisted platform for designing, visualizing, and documenting architectural cabinetry, including generated renders, layout previews, plans, and material selection tools. Features, plans, and limits may change over time.
3. Accounts
- You must provide accurate information and keep it up to date.
- You are responsible for keeping your credentials confidential and for all activity under your account.
- You must notify us promptly of any unauthorized use of your account.
4. Payment, subscriptions, and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by the Paddle Buyer Terms and our Refund Policy.
5. Acceptable use
You agree not to misuse the Service. In particular, you must not:
- Use the Service for anything unlawful, fraudulent, or to send spam.
- Infringe intellectual property, publicity, or privacy rights of others.
- Attempt to probe, scan, or compromise the security of the Service, upload malware, or scrape data in violation of these Terms.
- Reverse engineer, resell, or redistribute the Service, or circumvent any technical limits.
6. AI-generated content and outputs
- You are responsible for the prompts, images, drawings, and other content you submit ("Inputs") and for how you use the AI-generated renders, plans, and outputs ("Outputs").
- You represent that you have the rights necessary to submit your Inputs and to use resulting Outputs for your intended purpose.
- Outputs may be inaccurate or incomplete. They are visual concepts and are not a substitute for professional architectural, engineering, structural, or construction advice. You are responsible for verifying all dimensions, materials, and specifications on site before manufacturing or installation.
- You must not use the Service to generate illegal content, deceptive material (including deepfakes of real people without consent), hate speech, sexual content involving minors, malware, or content designed to jailbreak the AI models we use.
- We may remove or restrict content, refuse or filter Outputs, and suspend accounts that violate these Terms.
- If you believe an Output infringes your rights, contact us via the address in section 15 to request a takedown. We may terminate accounts that repeatedly infringe.
7. Intellectual property
Oblicuo and its licensors retain all right, title, and interest in and to the Service, including its software, models, documentation, and branding. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service within the plan you have purchased. As between you and Oblicuo, you retain rights in your Inputs and in Outputs generated for your account, subject to the licenses granted to us in these Terms to operate and improve the Service.
8. Service availability
We work to keep the Service available, but we do not warrant that it will be uninterrupted, error-free, or free of loss of data. To the fullest extent permitted by law, the Service is provided "as is" and "as available" and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
9. Suspension and termination
We may suspend or terminate your access to the Service if:
- You materially breach these Terms;
- Your account is in non-payment;
- Your account presents a security or fraud risk; or
- You engage in repeated or serious policy violations, including violations of section 5 or 6.
On termination, your right to use the Service ends. Where possible, we will provide a reasonable window to export your data before deletion, except where a shorter period is required for security, legal, or fraud-prevention reasons.
10. Limitation of liability
To the fullest extent permitted by law, Oblicuo will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill. Our aggregate liability for any claim arising out of or relating to the Service will not exceed the fees you paid to us (via Paddle) in the twelve (12) months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by applicable law.
11. Indemnity
You will defend, indemnify, and hold harmless Oblicuo from and against any claims, damages, and costs arising from your Inputs, your use of Outputs, your unlawful use of the Service, or your breach of these Terms.
12. Changes to the Service or Terms
We may modify the Service or these Terms from time to time. If we make a material change to the Terms, we will provide reasonable notice, for example by posting the updated version at this URL and updating the "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which Oblicuo is established, without regard to conflict-of-laws principles. The competent courts of that jurisdiction will have exclusive jurisdiction over any dispute arising out of or relating to these Terms, subject to any non-waivable rights you have as a consumer under your local law.
14. Assignment and force majeure
You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets. Neither party is liable for delay or failure to perform due to events beyond its reasonable control.
